CANCELLATION
POLICY
We require a
minimum of a 72-hour advance notification of dive tour
cancellation and a minimum of 5 days advance notice of
cancellation of certification class(es) throughout most of the
year or you will be subject to the full charge for the
dive(s)/certification class(es) you have booked. When you book
multiple days of diving and/or classes with us, we consider the
entire booking as a "package" and the cancellation
period is based upon the first scheduled day of diving. However,
we require a minimum of 10 days advance notice of dive tour and/or
certification course cancellation for dives/classes that are
scheduled to take place 10 days prior to and 10 days after major
holidays, including but not limited to New Year's Day, Spring
Break (Easter Sunday will be considered the actual holiday),
Memorial Day, Fourth of July, Labor Day, Thanksgiving and
Christmas. If you have paid with a credit card, we will
credit-back to your card within 72 hours of receiving your proper
cancellation notice. If you have paid with a personal check, we
will issue a refund upon notification that your check has cleared.
If you do not
cancel as outlined above and/or do not show up for your scheduled
dive time, you will still be charged the full amount. A lot of
pre-dive time is spent in selecting the gear and preparing the
site for your dive, as well as our Instructor's time while waiting
for you.
If dive conditions
are inappropriate for the skill level of the divers in your party,
at the discretion of the Instructor, we will either move to
another dive site, re-schedule your dive (working within your
vacation schedule), or cancel your dive and refund your money.
Akamai Divers of Kauai reserves the right, at no additional cost
or fee to you, to contract with another Instructor/Company to
provide the services that you have ordered.
If you show up
substantially late for your dive time (more than 20 minutes), we
may not be able to accomplish your dive as scheduled. We will try
to re-schedule another dive time (working around your vacation
schedule) but remember that we have other classes and tours
scheduled and may not be able to accommodate you. In this unlikely
event, you will be charged for the scheduled dive.
If anyone in your
party shows up to the dive site and is, in the opinion of the
Instructor, not able to dive safely and/or without jeopardizing
the safety and well-being of the other divers, then that diver may
be asked to stand down and not join in the dive. We will NOT take
divers who are intoxicated, under the obvious influence of drugs
and/or narcotic substances, severely overweight or
out-of-condition, or otherwise unable to safely participate in the
scheduled dive. In the event of any such occurrence, at the sole
discretion of AKAMAI DIVERS of KAUAI, each diver will either be
charged for the dive, have their monies refunded subject to a 50%
cancellation fee, or be charged other earned fee(s) as deemed
appropriate by AKAMAI DIVERS of KAUAI.
Remember ... if
you show up and do not complete the entire dive, tour or class, we
consider it as "earned fees" because of the time and
expense in preparing for your dive or tour, regardless of whether
or not you complete the entire dive, tour or class and accordingly
will not refund your monies.
If you are taking
one of our Certification Courses or Specialty Courses and are
unable to complete the required number of dives prior to your
departure, due to either inclement weather or other oceanic
conditions beyond our control, then Akamai Divers of Kauai will
pro-rate the unused portion of your Course, based upon the amount
of time and expense that we have encountered for your Course, and
will gladly refer you to another PADI Instructor for completion of
that Course. You will be responsible to make payment to that
Instructor for services rendered.
Any course materials or supplies
that have been purchased and delivered to you are yours and these
costs are not refundable. If the materials have not been delivered
to you prior to your cancellation, then a full refund will be gladly
issued. If you do not successfully complete the required written
quizzes, tests or examinations prior to your departure, Akamai
Divers of Kauai will be unable to sign-off on these Academic
proficiencies and you will be required to complete these
proficiencies elsewhere in order to earn your certification.
We will gladly issue a Referral
Form based upon those proficiencies that you have successfully
demonstrated understanding and mastery in upon payment of your
course/class/dives. We cannot and do not make any representations as
to what other third party or independent dive centers or Instructors
can, may or will charge for their times and services in the event
that you need to re-take any or all of the quizzes, final
examinations, confined water sessions or open water dives necessary
to earn your certification.
Remember ...
classes are paid for but certification is earned. If you
decide not to continue in the classes or courses, it is your
decision to do so. No monies will be refunded to you, because we
have set aside time for you and/or your group, whether or not you
decide to complete the class or course.
We cannot and do
not promise that you will pass the certification process, since
these certifications are "performance based". We do
promise you that if conditions are favorable to do so, Akamai
Divers of Kauai will provide training and instruction for your
classes, enabling your to earn your certification.
Again, if YOU are
unable to perform and/or YOU decide not to complete your classes,
we will NOT refund any monies to you. If WE are unable to perform
for any reason, then we will gladly pro-rate your tuition based
upon the time and expenses we have generated towards your
particular certification.
When you book your
dive, tour or class with AKAMAI DIVERS OF KAUAI, you are agreeing
to the above CANCELLATION POLICY.
